Sparkle Solitaire - Terms of Service

Welcome to Sparkle Solitaire! These Terms of Service ("Terms") govern your use of the Sparkle Solitaire mobile application ("App") developed and published by Blue Ant Software, LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, downloading, or using Sparkle Solitaire, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any iOS device that you own or control, solely for your personal, non-commercial use.

3. Restrictions

You agree not to:

  • Copy, modify, or distribute the App or any part thereof
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App for any unlawful purpose
  • Transfer or sublicense your rights under these Terms
  • Use the App in any manner that could interfere with, disrupt, or negatively affect the App or servers connected to the App

4. In-App Purchases

Sparkle Solitaire may offer in-app purchases. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. All sales are final, and we do not offer refunds for in-app purchases except as required by applicable law.

4.1 Premium Features

Some features of the App may require a one-time purchase or subscription. The specific features and pricing will be clearly displayed within the App.

4.2 Subscriptions

If the App offers subscription-based features:

  • Payment will be charged to your Apple ID account upon purchase confirmation
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
  • No refunds will be provided for any unused portion of a subscription term

5. User Content

The App may allow you to save game progress, statistics, and preferences. You retain ownership of any content you create within the App. However, you grant us a non-exclusive license to use, store, and process such content for the purpose of providing and improving the App.

6. Intellectual Property

The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, animations, and software) are owned by Blue Ant Software, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

8. Third-Party Services

The App may integrate with third-party services (such as Game Center). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the content or practices of any third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUE ANT SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or the like that may be transmitted to or through the App

11. Indemnification

You agree to indemnify, defend, and hold harmless Blue Ant Software, LLC and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your license to use the App will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by other means. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
